Trial

The culmination of the litigation at the lower court level is the trial. The case may be tried to a jury or to the judge depending on the parties wishes, the issues, and the parties’ contract. The judge may be called upon to revisit the injunctive issues decided in the preliminary injunctive phase. Generally, however, the trial phase focuses on what, if any, monetary damages either party has experienced due to the actions of the other. A trial contains many facets that your attorney will explain to you in more detail. Of course, either party may seek to appeal the rulings of the trial court.
